OFF-LOADING OF FILIPINO TRAVELERS: Is it fair or discriminating?

A total of 521 passengers were offloaded or not allowed to leave the country in 2011 because of falsified travel documents, according to a report from the Inter-Agency Council Against Trafficking (IACAT) NAIA Task Force Against Trafficking in Persons. The report showed that of the 521 passengers offloaded in 2011, 30 were classified as minors, 316 as Tourist Workers and 175 as OFWs with irregularities in their documents.. 'Tourist Workers' are people who attempt to travel for the purpose of gaining employment abroad without proper documentation and those people who attempt to go to countries where the Philippines currently has a deployment or travel ban, or those who provide spurious travel documents. Before I went here to Dubai, isa sa mga problemang iniisip ko is the PHILIPPINE IMMIGRATION. Sila yung mga Immigration Officers na kailangan mong daanan before you could board into the plane. Ang tanong, bakit sila naging problema sa akin or sa kahit sinong nagbabalak umalis ng bansa? ANSWER: Kasi meron silang kakayahan na pigilan kang umalis. Pwede ka nilang pigilan umalis kahit na nakapagbayad ka na ng malaking pera sa visa at plane tickets mo. Bakit? Hindi ko din alam. Sila lang ang nakaka-alam.

Bakit nga ba napaka-higpit nitong mga Immigration Officers sa Philippines? According to what I've read, since 2011, strict departure formalities have been imposed. All travelers are required to undergo what they called 'primary inspection' wherein a passenger should present a valid passport, required visa and a round-trip ticket.

For tourists, inspection thing doesn't just end there. After the primary inspection, the Bureau of Immigration (BI) is authorized to do a secondary inspection. According to the article made by Ruiz (2012) from the Manila Bulletin website, the secondary inspection was made "for the purpose of protecting vulnerable victims of human trafficking and illegal recruitment and other related offenses". The assessment will take into consideration age; educational attainment, and financial capability to travel. Its the discretion of the Immigration Officers (IO) if they would allow you to go out of the country or not. The question is, bakit meron pa ring mga passengers despite having complete or should I say enough documents to show, hindi pa rin sila pinapayagang umalis?

I came across different forums in the internet and I got the chance to read different cases of people being offloaded. Most of them were on visit/tourist visas. They were offloaded because there were insufficiency with their documents. Pero ano nga ba ang mga dapat dalhin na mga documents pag haharap ka na sa immigration?

According to Grace (2011) from her blog post about "Unjustified 'offloading of Filipino travelers", Despite having proper documents, Filipino still face problems at the immigration desks while exiting the country. The proper documents would include passport, visa to enter Dubai and that Affidavit of Support (a new document imposed last September 2010 by the Philippine Government supposedly to curb human trafficking but has been subjected to a lot of abuse and seen only as new money making scheme) authenticated at the Philippine Consulate in Dubai and Air tickets. But horror stories have surfaced how people are bullied into answering ridiculous questions like proving his/her relation with the sponsoring relative in Dubai (which have been proven during the notarization of the Affidavit), show money (cash on hand), ATM cards, Credit cards, certificate of employment in the Philippines, etc. 


I don't know if it was just my lucky day that day when I had my encounter with the immigration at NAIA Terminal 1. Iniisip ko nga nun mamimili ako ng babae na immigration officer (IO) baka mas mababait sila. Yun pala, pag dating dun, isa lang yung pila, tapos depende kung sinong officer yung unang mabakante, dun ka pupunta. Yung balak kong mamili at mapunta sa babae, hindi nagkatotoo dahil sa lalaking immigration officer ako napunta. Siya yung tipong pilosopong immigration officer na tipong huhulihin ka talaga.

Turn ko na nun na pumunta sa kanya, malayo pa lang, tinignan niya na kung ano yung suot kong damit, kung ano yung itsura ko. (sorry kuya, prepared ako, I was just wearing shorts, polo shirt na black, jacket and a running shoes that time, para mukang turista) when I stepped into his counter, binigay ko na agad yung Passport, Tourist visa, at yung card na maliit, Embarkation card yata yung tawag dun.

Immigration Officer (IO): Sino pupuntahan mo sa Dubai?
ME: My cousin, sir. (pinilit ko talagang mag-english para sosyal, haha!)
IO: First, Second or Third?
ME: First cousin, Sir.
IO: Ahh, sige punta ka muna doon sa secondary inspection ha, kapag pinayagan ka nilang umalis, balik ka dito sa akin.
ME: (at first naisip ko, ay shit! na hold ako, pero sinabi ko na lang..) Okay, sir.
IO: Nag-wowork ka ba dito?
ME: Yes Sir. I am working full-time as a Sales officer sa _____Corporation. and I am working as a part-time Market Researcher in ____. (That time, I came prepared, may dala akong Company IDs, Leave of absence, at Employment Certificates, pero ang hiningi lang yung Company IDs)
IO: (Tinignan nya lang saglit yung mga Company IDs, tapos sabi..) Pwede yun sa inyo? Dalawa trabaho?
ME: Yes, sir. (Pero sa isip ko, Obviously SIR!)
IO: (may ginawa lang sya saglit dun sa mga papers ko, hindi ko alam kung ano, tapos sabi..) Sige, okay ka na.
ME: Where should I go next, Sir? (nalito ako kasi sabi niya for secondary inspection daw ako)
IO: Dun ka na sa gate.
ME: (pagtingin ko ng passport ko, may tatak na.) THANK YOU SIR. (sabay alis)

Though thankful ako, hindi din naman ako nagulat na makakalagpas ako sa immigration kasi first time ko lang umalis ng country. Malinis pa ang passport ko. Prepared din akong humarap sa kanila. Lahat ng possible na documents na hingin nila sa akin, meron ako. Valid passport, Tourist visa, Roundtrip tickets, Affidavit of support, Birth certificate ko at ng sponsor ko, OEC ng sponsor ko, Copy of passport at visa ng sponsor ko, Company IDs, Leave of Absence, Employment Certificates, pocket money, at ultimo pictures na magkasama kami ng sponsor ko, meron ako.

Ngayon, nandito na ako sa Dubai for more than a month na, nakahanap na rin ako ng work at naghihintay ng visa. Wala naman akong balak takbuhan ang gobyerno natin sa pilipinas, mag paparegister pa din ako sa POEA/OWWA dito. Magiging documented overseas Filipino worker pa din naman ako. Hindi naman masamang pumunta ka at mag-apply ng work sa ibang bansa with a visit/tourist visa. Katulad dito sa Dubai, they allow it. Pag na hire ka, magiging working/employment visa yung visa mo. The thing is, kailangan mo ding isipin kung saan ang nanggaling at magparegister ka ng  maayos as a documented OFW. Yes, magbabayad ka ng taxes and all, pero its the law, you have to abide by the laws.

Dito ko naintindihan kung bakit ginagawa ng immigration yung ginagawa nila doon sa airport. Dito lang sa Dubai, napaka-daming Filipina na prostitute. I don't know if may visa sila (but I doubt, wala namang kumpanya ang gagawa ng visa for prostitutes) pero madami sila. Nagkalat. Hindi ko din masisisi ang gobyerno kung bakit nila ginagawa na mag-higpit sa airport at in-offload ang mga passengers na sa tingin nila eh magiging prostitutes lang sa ibang bansa.

Ang hindi ko lang naman mainitindihan, bakit sinasabi ng ibang mga tao sa mga forums na meron daw mga immigration officers na humihingi or tumatanggap ng 'suhol' para lang mapa-alis nila yung mga passengers. Pati tuloy yung mga tao na balak humanap ng matinong trabaho abroad eh naaapektuhan din. Sana gumawa pa yung gobyerno ng Pilipinas ng mas maayos na paraan para sa mga ganitong cases. After nilang magbayad for their visas, passports, plane tickets na hindi biro ang presyo (dito lang sa Dubai, it would costs 3000+ dhs. kulang kulang 40000 pesos) tyaka palang nila malalaman na hindi pala sila papayagan umalis or worse, susuhulan pa nila ang mga immigration officers ng malaking pera din para lang maka-alis. I'm not holding any facts here, I am just basing my judgments  sa mga nababasa ko sa mga forums and I don't think 'people' wouldn't create such things na hindi naman talaga nila na-experience, so, I guess, meron nga. totoo nga.

Hindi ko masisisi ang gobyerno for implementing rules like these kasi ang iniisip lang naman nila eh yung protection or yung safety ng mga Filipinos all over the world. Kung baga ang gusto lang naman nila eh maging documented lahat para kung sakaling may mangyaring masama, eh may record sila. Meron kasing mga tao na nag settle nalang sa pagiging undocumented, walang record sa POEA para hindi na magbayad ng taxes or kung anu-ano mang fee. Hindi din naman natin sila pwedeng masisi, kahit mali, gusto lang naman nilang mag kumita. Pero sana magawan nila ng paraan yung mga nagpapabayad na immigration officers. Sana isipin nila yung mga taong gumastos ng malaki para lang makapagtrabaho sila sa ibang bansa for their families.

Para naman sa mga taong balak lang maging prostitutes, undocumented workers at mag cause ng human trafficking, wag kayo magalit kung ma-offload kayo. Kayo nga ang dahilan kung bakit nag-higpit ang government natin ng ganito. Mas mabuti pa ngang na-offload kayo at least hindi kayo napahamak sa mga balak niyong gawin na masama sa ibang bansa. Think about it.

Kung noon ko sasagutin ang tanong kung fair or discriminating ba ang pag-offload ng mga passengers, I would answer its discriminating, no doubt. But seeing Filipinos here doing such acts na hindi na maganda, sila ang dahilan kung bakit napaka-baba ng tingin ng mga ibang lahi I'm sure hindi lang dito sa Dubai pati na rin sa ibang bansa. I think its just fair. Depende nalang sa tao. Maayos ang law na ipinasa ng Gobyerno natin sa Pilipinas. Depende na lang yan kung papaano ii-implement ng mga Immigration Officers, kung magpapa-suhol ba sila or not, depende rin kung papaano titignan ng mga taong maapektuhan ng mga laws na ganito.

MY TIPS FOR THOSE PEOPLE WHO WILL BE HAVING AN ENCOUNTER WITH THE PHILIPPINE IMMIGRATION:
1. If you are on a tourist visa, dress up like a real turista. (Wearing shorts is not prohibited in the airport, in fact, it could help you look more convincing)
2. Bring all the documents needed, when I say all, think of ALL the documents that an immigration officer could ask for (especially the filipino immigration na napakadaming hinihingi kahit wala namang connection)
***Valid passport, Visa and Roundtrip ticket (they will surely ask for a roundtrip ticket in case you are on a tourist visa)
***Company IDs, Leave of absence and Employment Certificates --- Just in case they will ask for all, in my case, they just asked for my Company IDs.
***Birth Certificate of you and your sponsor (to prove your relationship with your sponsor)
***Copy of the passport and OEC of your sponsor (just an additional documents)
***Photos of you and your sponsor together (I brought one during my time but they didn't ask for it)
3. When approaching them, don't be nervous. (Paglapit mo pa lang, titignan ka na nyang mga yan)
4. Answer their question STRAIGHT TO THE POINT. If you just need to answer YES OR NO, just say YES OR NO. No need for further explanations.
5. IF YOU KNOW IN YOURSELF THAT YOU ARE RIGHT, DON'T HESITATE TO REASON OUT. (In a good way of course) HUWAG KANG PUMAYAG MA-OFFLOAD KUNG SA TINGIN MO HINDI KA NAMAN DAPAT MA-OFFLOAD.

  2. dapat pala cool lang ang outfit mo, para d nila maisip na may plans ka to work there. tinitingnan din ba ng immigration officers ung dala mong bag kung gaano kalaki? cause im thinking na i should carry less pra tlgang turista ang dating. thanks, your blog is very helpful..

    1. Yup! Dapat cool lang ang outfit mo para turista ang dating. :) Regarding the bag, sa experience ko, hindi naman nila tinitignan yung bag. Yung maleta or luggage kasi, pina-check in ko kasi kaya hindi na nila nakita. Kasi bago ako humarap sa kanila, pinacheck in ko na yung maleta ko. Tapos yung hand-carry ko na bag, malaki din pero hindi na nila tinignan. Saglit lang yung encounter mo doon sa immigration! Pray ka lang! Goodluck and Godbless! :))

  3. Ang masasabi ko lang...documented ka na kung nakadaan ka sa immigration. Yong mga immigration officers,,,wala silang pakialam kung ano ang gagawin namin sa Dubai, Buhay namin to. Gusto lang namin makahanap trabaho sa Dubai kesa mamatay sa gutom dito sa Pinas...wala namang ginagawang trabaho ang gobyerno..puro sila makasarili..payaman sa kurakot.Yong tungkol sa pagiging prosti ng mga babae, diskarte nila yon...kahit saang bansa may mga pinay na prosti,,,pwedeng dahil sa pera o pamawi sa kalungkutan..whether we like it or not gusto nila yon. importante wag nila harangin ang karapatan ng mga tao..maghanap ng pera para sa pamilya nila..this is really discriminating..mantakin mo nasa pre departure ka na ..pwersahan kang i off load...? pamemera na lang yan,,,why should the counter officer stamp your passport kung di ka pinayagan? dapat doon pa lang hinarang ka na...paano nila malalaman kung bibiktimahin ka o hindi? hindi sila marunong magtanong ng tama kung pano hulihin ang mga posibleng biktima...pamemera lang yan..buti nga naka alis ka..congrats..wag ka ng umuwi kung di ka rin lang nakapundar...start a business or buy proerties for investment...regards....to all your family...

    1. When I say documented 'worker', I am talking about being registered in OWWA or whatever government agencies that deals with OFWs. I know and I agree, puro pangungurakot lang ang alam ng most of the government agencies sa Philippines but they do have good benefits as well. Sino bang sinisisi ng mga tao kapag may nangyari sa kanilang masama sa ibang bansa? Gobyerno nanaman. Minsan nasa tao din yan. Yes, diskarte ng mga prosti na yan kung ano ang gusto nilang gawin sa ibang bansa, but sana lang, hindi madamay ang ibang taong nagtatrabaho ng maayos. I bet you will ask paano sila nakaka-apekto? Bumababa tingin ng mga ibang lahi sa mga Pilipino. Buti kung sa mga prosti lang bumababa ang tingin ng mga tao, but NO, sa LAHAT ng Pilipino, including you and me.

      I have nothing against the prostitutes or whatever you wanna call them, I am just saying na because of human trafficking kaya nag hihigpit yung gobyerno sa mga taong umaalis ng Phlippines, kaya nagkakaroon ng offloading. Yun nga lang itong mga immigration officers, ginagawang way din to make money, which is SOBRANG MALI.

      I agree with you, hindi nila dapat harangin ang karapatan ng mga tao, including the right to travel. But then again, it depends on the purpose. Its true, walang pakialam ang mga immigration officers or ang gobyerno in general kung ano yung gagawin natin sa Dubai or kung saan mang bansa, pero kung may nangyari sa iyo, sa akin o sa ating masama, pwede bang sabihin din nilang wala rin silang pakialam sayo, sa akin, sa atin? Do you think people will buy that?

      Ang against lang din naman ako eh dun sa mga nagsusuhol na mga immigration officers eh. Kung meron man, sana mahuli na sila or better yet, matanggal na silang lahat sa pwesto kahit wala ng matira sa immigration section ng lahat ng airport.

    2. i believe that just recently, the bureau of immigration have set some guidelines on what are the things they need to know on an interview for filipinos holding tourist/visit visa before they can stamp your passport for boarding. CCTV cameras are set on each secondary inspection/interview, to review those conversations, if ever complaints may come. In my opinion , it is the right of every Filipino to travel anywhere they would want, but it is also the responsibility of the Philippine government to take care of its people from Human trafficking, being a drug mule, and other forms of abuse especially to filipinos who can be easily exploited like women/ minors and filipinos with less educational attainment. My cousin just came here last July 22 successfully without any hassles at all, our relation ship as first cousin was proven NSO birth certificates, She doenst have any current job even. She just told the IO, that she just recently passed the board exam for teachers and that she will be back for a government position in a school... It was unbelievable!! She made it through!! The IO didnt even bother to look at my OEC/ OWWA registration certificate which I sent to my cousin all in original... Lastly, prayers work... all the time... God bless :-)

    me and my friend are planning to go to dubai our other friend who lives in dubai will be the one to sponsor us..
    like you mag tourist visa po kami then apply for a job when we get there..
    just want some advice cause like you it's my first time to travel outside the country so malinis tlaga yung passport ko.. and knowing na friend and hindi relative ang sponsor nmin hindi kaya ma question po un and maging reason para ma offload ako? i'm just 22 years old ang my friend is 25 both female.. hehe
    kinakabahan tlaga ako sayang ang pera pag ganun.. hehe

  5. sorry for the late reply. :) ang nakikita ko lang naman na negative sa case mo is yung hindi mo relative yung mag sosponsor sayo. Yun ang mahirap, siguro to decrease the chance na ma-offload ka, dala ka nalang ng supporting documents like Company IDs, employment certificates stating that you are currently working in the Philippines at leave of absence. Kung baga, dala ka ng patunay na talagang babalik ka sa pilipinas. Kaya mo yan! tarayan mo lang sila sa mga sagot sigurado pasok ka! dasal ka din. :)) Godbless!

  7. hi i plan to go to dubai this coming sep pero napag usapn namin n bf ko n mag singapore muna ko for 3days tas from singapore mag dubai ako my tour package n ko p singapore roundticket cya pra kunwari babalik p ko ng philippines my visitvisa n ko and my ticket n ko from sg to dubai but 1way ticket n lang yng papnta kong dubai ok lang b yun hnd b ko mahaharang s singapore pag 1way n lang yng ticket ko ipapakita...

Im going to dubai dis coming nov 5. and i am using visit visa.. ung sponsor q ay 2nd cousin q.. and ung visa and ticket and supporting docus ay pinaprocess sa one of travel agency sa dubai. Ang meron p sakin n document ng sponsor ko ay scan na passport, residence copy at labour copy. then his marriage contract...kc ung NSO birth certificate nia ay ndi nila dndala... nakalock lng dw un sa house nila hir sa phil. ok lng b n marriage contract ang ipresent? at ung OEC pde bng ung labour copy po nya? Wla rin po aqng work now here phil. i already resigned. ng free freelance lng po aq minsan sa house. can you give me some advice?

  13. Hi. Pupunta dito sa dubai ung 2 kapatid ko. ung isa is nagwork na dito for 6 years, babalik lang sya after 8 mths. She has no work in phils. Ung isa is fresh traveler but he has work in phils but def when he leaves for dubai, mag reresign sya. Now, anong company Ids and leave form ang ipapakita nila if they dont work in phils? and u think mas ok na magsinungaling sila sa officer or it is ok to say na may sister sila sa dubai and they will come here for visit and pag may good opportunity e they will grab it. what do u think? thanks

  14. hi i just want to ask ksi kakaoffload lang sakin last nov 19 and the immigration officer provided me a lsit of requirements to be completed para daw nxt na balik ko ipakita ko nlng sulat nya and the requirements, gusto ko lang malaman if theres still a posibility na maoffload ako ulit kht na kompleto ko na yung requirements ko na hinihingi nla? natatakot na ksi akong maoffload ulit.. sbrang stressful nun una kong maoffload i even got a high fever after that day.. thank you!

  16. Hello po! I read different blogs about this situation sa Philippine Immigration. And I'm having the same dilemma. Plan po namin kasi ng bf ko na pumunta sa dubai via tourist visa. Yung sponsor po nya is kapatid nya, sa akin po yung mag sponsor sa akin ay hindi ko po relative. And currently, I don't have a work here in the philippines. May possibility kaya na i-offload ako cause of my sponsor dahil hindi ko naman siya relative? At ano po ang sasabihin ko or ipapakita ko sa immigration na ID kung wala akong work dito sa pinas? Please response po..thank you. :)

I'm here in Dubai and naranasan ko rin yung feeling na takot ka humarap sa mga IO ksi nga uso yung offloading nowadays sa NAIA.Mga "kabayan" just be confident and be prepared,dress up tlaga lalo na kung tourist ang entry mo sa dubai. COE,leave of absence and OEC ng sponsor mo ang pnka.importante na documents na klngan mong ipakita sa IO lalo na kung hindi kau related ng sponsor mo.

  20. hi. just want to ask. when you left for dubai, employed ka pa din at di nag resign that was why u still had your company ID? did u just tell ur office when u were already in dubai that u wud not be back to work? What's the duration of ur travel as reflected in your plane tickets? Thanks.

  21. Hi im a singaporean and i intend to bring a Philippines friend over to singapore for a one week trip in october. I will go there and fetch her and we will go to the inmigration together. If my friend unluckily got offloaded, can i extend my stay in philippines (by exiting the airport and forfeiting the flight) or do i have to fly back to singapore first then return again?

  22. Hi im planning to go to Dubai this September. My cousin (3rd degree) will be sponsoring my visit. Regarding sa LOA ko sa company ko, i dont think it is possible na mag LOA for tour reason lng. Sa call Center kasi ako nag work ngayon. Is it ok to just present COE lang sa IO and other docs like valid passport, Tourist visa, Roundtrip tickets, Affidavit of support, Birth certificate ko,Company IDs. Is there any chance na ma-offload ako with those Docs? Thanks.

  23. hndi po ako nagtatrabaho dito s pinas,kya wala ako ng mga certificate of employment o mga company id.
    at ano nman po un affidavit of support at OEC na nangagaling s sponsor ko,pki explain po.

Offload ako lastweek kakaasar.. 2 hours questioning tagal di ba.. pero ndi ako natakot sa kanila kse tour lang naman talaga gagawin ko sayang ticket ko..wala kse ko dala birth certicate ko at ng sponsor ko, saka gusto nila original affidavit of guarantee ndi scan copy.. and ung oec nya kailangan lahat original.. so wait ko lang padala lahat ng auntie ko original copy na hinihingi sken.. para iaallow daw nila ako to leave Philippines. ..

    Okay lang ba kahit walang hotel accomodation? sa Vietnam kasi ako pupunta for 4 days backpacking tour and solo lang ako. Mahigpit ba sila pag Vietnam? I'm planning to book a room when I get there. Need you advise please..
